FWIW, we ship heads to and from California alllll day long. It's usually around $55 retail from Maryland to there, each way. Even with a 25% surcharge to ship across a boarder, it'd be less than $100.

Fucker should either drop-ship, or he should be eating the Calgary -> BC shipping charges. He's selling goods not in his possession. You can get real burned doing that.

You entered a legally binding contract to buy the item. You didn't check on shipping, you took the chance...

It was legally binding until both parties agreed not to honor it. Besides, I'm not sure if it's legally binding anymore if information is withheld or the item is incorrectly advertised.

If it is truly a legally binding contract with regard to adding on whatever they want for shipping, then everyone would charge $10000 for shipping. Then sue when the other party didnt pay.

I would do some serious betting that I would win in a legal arguement. He has stated he is trying to make up for the low winning bid, he is charging ME the cost to ship the item to him, and he is guessing the actual shipping cost.

I'm sorry, but I don't understand why you screw around with these auctions that don't state the shipping up front (without at least asking them what it will be to your zip code).

This is what it says everytime before you confirm a bid. So you 'sign' a contract that says you agree the item will cost X dollars and will have an unspecified amount for shipping. And that is exactly what you got. I hate to see if you apply this to other parts of life. This house costs X dollars with a unspecified amount for monthly payments and this credit card gives you X amount of credit with an unspecified APR.... :roll:

Excessive Shipping & Handling


eBay encourages sellers to clearly describe the item and terms of shipping and delivery in their listings to avoid possible confusion.

A shipping and handling fee can cover the seller's reasonable costs for mailing, packaging and handling the item. However, shipping and handling fees may not be listed as a percentage of the final sale price.

When a bid is placed, the bidder is entering into an agreement with the seller to purchase the item, which most often means incurring reasonable shipping charges that may also include handling fees.

In the case of disagreements between buyers and sellers regarding shipping charges, eBay encourages the parties to try to work the matter out.

Violations of this policy may result in a range of actions, including:

Listing cancellation

Limits on account privileges

Account suspension

Forfeit of eBay fees on cancelled listings

Loss of PowerSeller status

"reasonable" shipping charges are acceptable. "unreasonable" shipping charges, which this clearly was, voids the contract.

On the auction site he says will ship via UPS ground. Thats fine and dandy, cause thats a known cost.

He ADDS his cost to ship the heads to himself via freight and tacks this shipping charge to the overall charge. Not stated, nor acceptable by any means.

And yeah, I will apply this to my life. When I buy my house, I don't expect to pay surprise fees, cause they are illegal.

Cool, I didn't know that clause was in there. I rarely deal with people who don't give me a price up front.

Just as long as you realize it is a legally binding contract when you bid. And it does suck with all the shady sellers out there. I've had quite a few refund most of the money after I pointed out something they were trying to pull. One sent me money back ALONG with some more product. The 5-letter "f" word seems to set them straight pretty quick. :)

P.S. - Its fraud, by the way. ;)

I calculated from Victoria, BC to Nashville, TN a 60lb package on April 10th takes 8 days and cost $107 CAD to ship. ($92.65 USD)


so I replied:
Is that CAD? Because if that's CAD, then $190 CAD is $163 USD.

Which is still expensive, considering 22T heads weigh ~24lbs a piece (you know, being aluminum) I calculated a package coming from Victoria (a reasonable estimation) with a $200 CAD declared customs value and $150 in insurance would cost $107 CAD (Approx $90 USD) to ship to 37211.

Is this going to recieve special treatment, such as a blessing from the pope, for that kind of cash?

please tell me why it's so expensive, and my cost includes fuel surcharges.

i'm glade you know teh shipping system because i have not a clue when it comes to rates anymore...but anyways the heads or in edmonton alberta and they will be shipped to me then you

I am pretty damn happy now that I didnt buy them even at the possible "lower" shipping. I am pretty damn sure they don't have cams.
