Bad Ebay Seller

Reason: Sells items they don't have.
I won a bid with this user about 3 weeks ago for an intake for my car. I contacted the seller a week later with questions as to why I didn't have my intake. 3 days later they contacted me saying there was some sort of problem with the intake and they couldn't send it. I asked them how long it would take to get a new one (after they offered me a red one - I paid for a black one) and they said 2-4 weeks. So, I declined and told them to give me my money back. I also left they negative feedback because they didn't complete the transaction because they didn't have the item exactly as they were selling it on ebay (making the listing wrong). So, they left me negative feedback with a request for mutual withdrawal. They cited that they contacted me and are awaiting reply, yet I sent them an email two days ago stating I want a refund and have yet to see a refund or an email about it. I'm pursuing a resolution to get my negative feedback post removed.
