Do NOT buy from 86ruguy!!! UPDATED - Dave Paid Me Back
Dave (86ruguy - David Stach legobrick92@yahoo.com) ripped me off and I warn all of you not to do business with him!
He's a liar and he stole $385 from me and it appears as if he has no intentions of giving it back. He thinks he's gotten away scott free, but this is not over with yet. I'm going to call the police as paypal suggested and have them contact paypal so I can get his address and I can go from there. Paypal is giving him 180 days to come up with the money before it goes to collections. Which is bullshit, he doesn't deserve 180 days after he's already had my money for over 2 months, since april 2nd 2009.
He's the story.
Dave was selling a few things on this forum, including a set of hella supertones (loud horns). I wanted them so I offered him a price shipped and he said he'd do it for that price but he would meet me locally so he didn't have to pay for shipping. I met him, bought the horns and as we were talking about subarus I mentioned that I was looking for an EJ22T for my car and he said a friend of his was actually selling one for $350. Great!
Dave called the guy up and confirmed he still had the engine and would sell it for $350. Dave said he lived up in Port Orchard, WA which is probably an hour and 20 mins from my house. Dave lives up in lakewood or tacoma area somewhere so it's much closer to him. He said he could pick up the engine for me and even deliver it to my house since he works 20 mins from my house. Awesome!
So I gave him $385 to give to his friend and pick up my motor. Several days go by and I contact him asking about it and he tells me his friend has gone out of town because his aunt died and he should be back in a week. Understandable. Except, a week goes by and I ask him again if he's talked to the guy and he says he's been busy and the guy's not answering or something.
Anyways, to cut if a bit short, I keep trying to get him to go get my engine and he keeps making up excuses and half the time his phone is disconnected. So then I finally told him to give me my money back and I'll find another engine. So then he says, OK I'll try one more time to contact my friend and get your motor and if I can't get a hold of him I'll give you your money back but it'll take a few days to transfer from his acount.
That's when I started looking on craigslist for a different motor while I waited to get my money back. Sure enough, I found one right off the bat and it was in Port Orchard.....for $350....odd. So I emailed the guy and asked him if his name was Mark (Dave told me his friend's name was Mark) and if he knew Dave and asked him what was going on. He writes back telling me his name was indeed Mark and he was the guy who had the motor and he knew Dave...sort of. Actually he didn't really know him, he had only sold him something once or bought something from him, I can't remember.
Mark tells me Dave did contact him saying he had the money and was going to come get the engine but that was a long time ago and he hadn't heard from him in weeks and that's why he put it on craigslist.
So I asked Mark if he had gone out of town due to a death in the family and Mark says no such thing ever happened and he's been home the whole time!
Now I'm getting furious. Dave is obviously lieing to me and keeping my money.
I pm'd Dave on here and confronted him with the facts from Mark and then he tells me the child support people took it out of his acount the moment he got it from paypal.
Why the hell would you lie to me then? Asshole.
I didn't know whether I should believe that BS or not. I gave him some slack to come up with my money. I didn't hear from him for quite some time after that. I tried contacting him on the forum, tried calling his cell and it was disconnected. He stopped posting on the forum at the same time and I haven't seen him since.
So I filed a paypal claim against him and not 1 hour after starting the dispute, he responds to it saying he just got his internet back and he can give me some of my money but not all of it.
That was the last I heard from him. On May 12th, 2009. 6 weeks ago.
He never bothered to keep in touch with me. Only time I ever heard from him was if I contacted him and that was a maybe.
He's a shady character, he stole my money, doesn't even have the respect or courtesy to keep me updated on how he's going to get my money back to me. And now he's just dissappeared off the face of the earth.
I'm going to get my money back one way or another!
Avoid Dave at all costs.

Dave, I talked to mark on the phone and through a few emails and he told me that he never had a family emergency and he hasn't been out of town. He said you called him about the motor and he was holding it for you and then you never called him back again and he hasn't hear from you in 3 weeks.
What's going on Dave? Do you have my money? I'm going to go up there and get the motor from him myself. I need my money back to pay rent and insurance and my loan and my phone bill and the internet.
I don't think you're being honest here. I'd really like my money back now. I have tried to call you and your phone is disconnected or something.
Hopefully we can get this sorted out between the two of us.

Kimo, I did contact mark more than once in three weeks, hwever there is an issue.
Long story short, I have a child support owing balance an they are not supposed to be able to touch MY WIFE'S account. Which is where I transfered the money to because Mark does not have a Paypal Account. By the time I got to the bank(actually my Wife) Support Enforcement had drained the account.
Needless to say, I Have been trying to come up with your money ever since. My hours at work have been really down and I will get you YOUR money as soon as I can.
I'm not using this as an excuse I'm just explaining.
My home phone is 253-503-0976, Call me sometime tonight as I have to work today.

Here's my emails with Mark (the seller of the EJ22T) but they're in the wrong order because that's how they were in my email. So you have to start at the bottom.

Kimo,
It started and ran fine the last time I tried it, it did sit for several months after the last time I started it though? I had a problem with a rat building a house (nest) on the motor of our Cadillac every night in my garage after my wife would get home from work, maybe he moved to the subaru? I didn't realize there was damage to the wiring, can it be repaired?

Hey Mark,
You sure this motor ran good? As I was removing the timing covers I found a section of the wiring harness melted with several wires with melted jackets and the wiring exposed. I also found a hose in the back that comes off the intake manifold that's either been eaten or corroded or melted away.
I'm thinking I might just tear the whole thing down and have it rebuilt and put my EJ20G DOHC heads on it and my TD04 and 2006 WRX top mount intercooler.
Kinda actually looks like a rat or mouse was chewing on both the harness and that hose on the back of the engine.

Hi Mark,
I was wondering if you had Dave's address? He still hasn't given me my money back and he doesn't bother to email me once in a while to keep me updated on the situation and hasn't responded to my email. I may have to take legal action soon.
Thanks

Well, that's a bit tough timing for me. I work nights from 8pm til 4am and I'm off wednesdays and thursdays. I usually don't get up til 4 or so. I leave for work at 7pm. Mapquest says it's an hour and 20 minutes to port orchard from Tenino. I guess I could get up early and get up there by 4 and have time to get back here and unload the engine and go to work. It would be a tight squeeze.
I need to know if you told Dave you were going out of town for a family emergency or not so I will know if he's making things up. He was supposed to call you yesterday after he got off work and then call me. He did not call me and I called him and his number is still "not accepting calls at this time".
It sounds really suspicious the way things are going with him. I really don't see why it would take so long to transfer money or whatever to get it back to me. Should be able to get me my money the first day the bank is open. I got the money to him immediately that way.
Anyways, I can make saturday work or sunday so long as you know you'll be home at 4 for sure. Or if you want we could wait until wednesday or thursday and I'll have a more flexible time schedule.
Thanks, mark.

Yeah I definately want it. When is a good time to come pick it up? What day/time is good for you? I've had a hard time finding one of these engines and my car has been sitting since september waiting for an engine.
Dave emailed me back last night after I asked him if that craigslist ad was for the motor I've been waiting for and he said it was indeed you and that he was going to call you today after work and call me back. So maybe he can give you my money? But either way, I've got enough money still to pay for it out of pocket again and deal with that later if need be.
Thanks

I really don't know Dave other than I've sold him some parts but he seems like a nice guy? I have a few other people interested in the motor right now but I'd hold it for you if you want it for sure since it should be your already?

Really? He told me you had a family emergency and then after that he said you haven't been answering your phone. So you didn't have a family emergency and leave? I already told him I wanted my money backand he said it's gonna be a few days because he has to transfer it or something.
I need to know what happened because he's got $385 of mine and I still need that motor. So I still want that motor and I can come get it and I've got the money.
Hopefully this is just a misunderstanding.
Thanks

Your right, I'm the guy with the motor that Dave was suppose to pick up weeks ago and just never showed up or called? I've been here, I haven't gone anywhere? Yes the motor is complete and runs but as I told Dave, I would replace all the hoses belts etc. If I were you I would tell him to get you the motor this weekend or give you your money back.
Thanks, Mark 360 895-4026

Hey I saw your craigslist ad today for the EJ22T motor. You wouldn't happen to be Mark would you? If so I have been trying to buy your engine through a friend of yours, Dave. I gave him $385 to get the motor from you and bring it down to Tenino, WA to me.
He said you've been out of town and I gave him the money 3 weeks ago. Anyways I just asked him for the money back so I could find a different motor because I need my car to be running.
If I'm mistaken and you're just another guy from the same town with the same motor for the same price...sorry haha. I'll buy your motor then!
It ran good right? It's complete as well right? Ready to drop right into my 91 SS? I need an EJ22T motor!!!
Get back to me soon, thanks!

Kimo,
It started and ran fine the last time I tried it, it did sit for several months after the last time I started it though?

Kimo,
I'm sorry to hear that. Sorry I don't have his address. I'm not sure if I even have his phone number any more? Why don't you give me his number and I'll call him and act dumb and ask him what was going on with the motor and the money?

Hi Mark,
I was wondering if you had Dave's address?

Thanks

What do you guys think I should do next? I would like to take him to court but every time I think about it, I think to myself,"If child support people can't get the money from him, how the hell am I going to get my money from him?" But then again, maybe he made that whole bit up too? Maybe he doesn't even have a wife or kid?

A guy did this to me on ebay for a set of WRX brakes. I finally found out who he really was, including allot of information on him, and ended up sicking the cops on him for theft. He returned the money within the hour.
I spent hours doing detailed google searches and eventually got his address, workplace and all kinds of information (including that he was in a same-sex marriage). What was most useful was searching his username, which lead to other forums where he'd shared his location; then by that information I was able to triangulate a legal name, and through allot of name searching I found his addresses, etc.
When I first called the police they were useless, as usual, so I had to do all the detective work for them. Once I had done their jobs and found all the information, they agreed to pay him a visit in a squad car and tell him to return the money.

I second the cops. Since the dirtbags won't let you go and take a bat to someone like a man's world would allow, make them do something to earn their overcompensation and cushy benefits. They'd otherwise just be tailgating someone on the highway, speeding excessively, blowing red lights, hitting on high school girls, or eating donuts anyway.

You know what, I almost bought some stuff from him one day, but then I saw a post from Doug which made me think otherwise:
http://bbs.legacycentral.org/viewtopic. ... highlight=
Apparently the issue was resolved, but for a while there it was getting pretty heated.
I personally wouldn't recommend that anyone else buys from him again, seeing as this is the second time he's squandered away someone's money.
But in your case Kimo, I'd do some research on him, as fishbone suggested. Then just call the police, present them with all of the evidence you've gathered and have them get your money back.
Good luck! (<---I mean that in the most sincere way)

Yeah dude... getting screwed out of your hard-earned cash is one of the worst feelings. Fortunately for you, you have a record of everything... all you need is a police report and you could take him to small claims and get your money back (without needing a lawyer or any of that nonsense). Likely it would never get that far though, he'd pay up once he was served papers.
My experience buying stuff from board members has been remarkable as well, and I've bought (and sold) a ton of crap.

May not be his plate, but it will get you started. He bought the car from bill baxter (e.g, http://www.cardomain.com/ride/2962413/2), so I'd get ahold of him for some contact info.
Also, this address may help you out, but may be old... see below from 2007:

Little update. I was given his ip address and from there I googled how to locate ip addresses and found out he lives in Lakewood, WA about 35 mins from my house. I was also given his longitude and latitude from the ip address which I then put into a site I found for looking up coordinates on google and entered these numbers in and it pinpointed on a map exaclty where the coordinates are. Just how accurate it is, is uncertain but I'm sure it's close.
It appears as if he lives Madera Dr SW, Lakewood, WA on the right side of the street after you turn onto Madera Dr SW. See second map.
After doing a bit more searching I was able to get directions to his house but not his exact address. But this map shows his location at a slightly different place, across the street.
Here's a picture of Dave

That grey SS he bought that you see in his pictures in his photobucket album under "The NEW SS" was one I was trying to buy at the same time from a kid in Chehalis, WA I believe. Had it listed on craigslist and I was going to offer him like $400 for it because it had a bad auto tranny. But Dave got it first, I remember talking to him about it. I think he sold it not long after buying it though.

Thanks for all the info everyone. This will definately help with my police report. Especially since I just got his address basically and printed it out with pictures of all his subarus and their license plates and I already have all the other evidence of our conversations and my paypal reciept and my conversations with Mark about Dave taking my money and making up lies all printed out in a file folder ready to take to the police.
Awesome. I've been ripped off twice before on ebay and this is the last time I will let it happen.

Just a warning -- that's almost certainly not where his house is. IP geolocation's just not that precise. All you really know is that he's close to Lakewood. Try punching in your own IP address and see what result you get.
You should also punch the IP address into a WHOIS query. That will tell you who his ISP is (and give you their contact phone number and address). http://www.networksolutions.com/whois/index.jsp
If this is a case of wire fraud (I don't know if it is or not), you and/or the police may be able to get some help from the ISP. The ISP can in fact turn the IP address into a street address.
Also, this may be obvious, but save any relevant pictures or files to your hard drive.

Alrighty. Josh just told me that is most likely not his address either.
That's good to know though. I will check into the WHOIS query when I wake up this afternoon.
It was a paypal transaction through my debit card. I believe. Could have been my bank acount, I can't rememebr I'll look into that too..
Thanks

Yeah, the RIAA was using that method to locate and threaten music pirates and that's how they ended up taking people who don't even own computers to court.

I hate the RIAA and the MPAA. I did a report on the RIAA back in sophmore year or something. Bunch of assholes they are.
Are they still sueing people? Haven't heard of anything in years.

Hey... I know Dave...
But I just got off the phone with him, he says he hasnt had internet for the last two months and you should call him...
He said he got a call about this from one of the moderators from USMB last night... about all this.
He asked me to tell you to call him, I know his phone is working right now...
I'm guessing you have his number but here it is again.
Hope this helps at all.

Yes, I got a text from him while I was asleep. I'm calling him now.
It's odd that this is the second time I've started to do something serious about this and he comes right out of the woodwork finally. Like when I finally filed the paypal dispute after not hearing about him in weeks and then an hour or so later he responds to it.

Somebody called Dave. In fact, apparently more than one somebody. Because out of the blue yesterday morning at about 11:30am while I was asleep I got a text from him and he sounded a bit angry because he said 6 people have called him about this thread.
So whoever that was, thank you. He told me in his text to call him and so I did and of course there was no answer and it went to voicemail after several rings. So I left him a voicemail telling him to call me and even gave him my number in case somehow he lost it.
No call back from Dave. That was at like 3 in the afternoon probably and it's now 7am the next day.
I'm sick and tired of trying to get a hold of him, it's useless.
I think if I have time today I'll call the police and see where we go from here.

That's probably your best bet. I'm sure they could 'scare' him in to coming forth with your money by leaving him a nice message filled with threats about having a warrant out for his arrest or something if he doesn't. That's what they did for me at least haha.

Stupid police departments close at 5pm! I went there right about 5pm and there was no one there. No hours posted outside, nothing. Just an emergency phone. Why would you not post the hours so I know when to come back.
I called 3 police departments when I got home and they all close at 5pm. So I'll have to go back earlier tomorrow.
I'm wonding if I'll have to contact my local police or the lakewood police to help me out with this.
I left Dave a message when he didn't answer yesterday telling him to call me. Of course, he has not called. I'm not going to play games with him anymore. I'm not going to call him again. He's had his chances and he's shown me no respect.
