You keep saying that. ABS is NOT a saftey control device. The US DOT never says that ABS saves lives. In fact, they say that it can actually HINDER driver performance if it's not properly used (which could never be proved in court). If ABS was a saftey control device, it would be required by the FMVSS. But it's not. They would have to prove that deactivation of ABS systems contributed to the accident, and they couldn't do that. It's not that they wouldn't try, but they would have to prove that the driver was unable to slow the car faster without ABS than with.
You could take it to court, but try proving it. Good luck.
With my RE070's and after the brakes are nice and hot and the tires are hot and sticky, I can lock the wheels up reguardless of ABS being on or off. ABS tried, but failed to control the wheels.
Fuck, a shark lawyer could claim that you used non OEM tires, and that contributed to you hitting the pedestrian. But they won't. Because the one thing that Jury's hate, is when they are insulted through prosecution. It's almost a sure thing that every person on the jury has some non-OEM part on their car, and saying that non-OEM parts were the difference between life and death, is bullshit.
