can you swap the center diff from a '91 legacy MT to a 2002 WRX MT to keep the 3.9 rear diff?

Nope you can't sorry to say. The center diffs are different. Your center diff is a phase I and a WRX center diff is a phase II diff.
Isn't the wrx one 3.54, 3.45 or something I forgot which one. Some one else I'm sure will jump in.
There is a thread around here showing the difference between the center diffs.

The transfer gears are 1.1:1 to make rear need the 3.545.

will the transfer gears physically work in the 3.9 tranny? if so you could do this swap if you want to run a wrx rear diff too. 1.1*3.545=3.9

I couldn't tell you. I haven't taken a newer trans apart, and it's been almost ten years since I disassembled an old 5mt.
It's not that hard to swap a ring and pinion on a rear diff.

Can't you take the transfer gears from the SS 5mt and put them in the WRX 5mt?
