Is the bracket on the transmission connected? And the one on the mid pipe?

That's not right. It should be much higher than that. Can you take a picture of the down pipe. I second Charles's question, is the bracket holding the downpipe to the transmission connected?

Then I would say your problem stems from your down pipe sitting too low, which is probably due to how it was made. The down pipe & mid pipe are all relatively level and don't change elevation. Its elevation is determined by the bend point on the down pipe.

I know a lot of guys run the Megan and I haven't read any complaints. I have a cheap@ss HKS flat-flange and it sits at the right height. I'd search for threads about down pipe fitment, and see what others have recommended.

If they are meant to work with the non-twin scroll turbo WRX's it'll work with your Legacy and just the length would need to be adjusted.
I really think your current problem is poor quality and/or sloppy craftsmanship.

i've seen this before that gap at the tranny cross member is likely one of two things.
1. the hanger on the downpipe is possibly bent up or not in the proper position for good ground clearance.
2. the downpipe is too tall or has the wrong bend for proper ground clearance

i have a new dp waiting to go on. its a better quality one. its a invidia dp with 2 O2 bungs the shop thats putting it on said it will hug up alot better

I had the same problem with my turbo back and had to shorten the height of my STI down pipe by about 3 inches to make it fit snuggly.
